US Supreme Court gives Big Tech a coveted victory; continued protection for Section 230

Tech companies won’t be held liable for user posts and any subsequent disinformation – thanks to two Supreme Court cases won by Google and Twitter. The companies and tech platforms withstood a challenge to Section 230 of the Communications Decency Act. Established in the early days of the Internet, Section 230 protects companies against liability for postings of users. So, despite growing concerns now about disinformation, discrimination, and violent content on social platforms and sites, these justices opted to side with corporations.

EU hands Meta $1.3B non-compliance fine and desist order

Ireland’s Data Protection Commission fined Meta $1.3 billion and ordered it to stop transfer of Facebook data collected on European users to the US. It is one of the most consequential rulings since the General Data Protection (GDPR) law was enacted and is the result of an EU court’s ruling GDPR protection was violated. IT’S THE LAW (05/23/2023)

Hong Kong and the Philippines have signed a Memorandum of Understanding (MOU) to work together to strengthen privacy rights for citizens of each. The Office of the Privacy Commissioner for Personal Data of Hong Kong (PCPD) and The National Privacy Commission (NPC) of the Philippines have established the alliance to ensure more robust data governance, safeguard data subject rights, and to work together on breach investigations, training and education.

Children’s Privacy: YouTube algorithms found steering gamers to guns

A study by non-profit Tech Transparency Project evaluated videos recommended by YouTube algorithms and found the platform recommended hundreds of videos about guns and gun violence to boys interested in video games. These included videos that showed how to make and enhance weapons or depicted school shootings – all of which are in violation of YouTube’s stated policies about depiction of firearms and violence, and to protect children’s safety.

Children’s Privacy: Chinese police alert parents to check messaging apps that may try to involve their kids in crime

Local police across China alerted parents that encrypted communications apps, including Telegram, which can encrypt or immediately erase content, have been used by criminals to defraud children – and sometimes even involve them as accomplices in crimes. Parents were advised to check kids’ cell phones for encrypted apps and to remove them if found.

Martech Budgets Expected to Grow Despite Headwinds: CMO Council Report

This CMO Council report for Sprinklr takes a gloomy position: the headline is 66/% of marketers lack confidence in their ability to meet revenue goals, although that includes 39% who are moderately confident. More cheerfully, 36% are increasing their martech budget for 2023 compared with 25% planning to cut it. Back on the dark side: just 23% say they have a very effective relationship with IT and just 19% strongly agree they can convince their CFO to not cut the marketing budget.

41% of Marketers Unfamiliar with Cookie Alternatives: IDC Study

Most marketers (60%) think consumer concerns about tracking technology could hurt their brand reputation and the same fraction agree user tracking will soon be obsolete, according to this global IDC study for Ogury. Despite this, 41% remain moderately or not at all familiar with cookieless alternatives. Ignorance may be bliss: 61% are confident they’ll be able to reach audiences at scale in the future.
